Welcome to MarketView Agency ("MarketView," "we," "us," or "our"). MarketView Agency is an independent insurance agency that helps individuals, families and businesses compare and apply for life insurance and related coverage from multiple insurance carriers. These Terms of Service ("Terms") govern your access to and use of marketviewagency.com and marketviewinsurance.com (together, the "Website"), including our quote tools, coverage calculator, forms, and any related calls, text messages, emails, and services (together, the "Services").

By accessing or using the Website, requesting a quote, submitting a form, or opting into our communications, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Website or Services.

1. Eligibility

You must be at least 18 years of age and able to enter into a binding contract to use the Services. By using the Services, you confirm that you meet these requirements and that you will comply with all applicable laws.

2. Who We Are

MarketView Agency is an independent insurance agency, not an insurance company. We do not issue policies, set premiums, or make underwriting or claims decisions. Insurance products are issued by the insurance carriers we work with, and each policy is governed by that carrier's contract, terms, and conditions.

Licensing: Insurance services are provided by licensed insurance producers. National Producer Number (NPN): 18345705. You can verify our license at nipr.com. We can only offer and sell insurance in states where we are licensed: Kansas, Texas, Florida, Ohio and Georgia. Products, carriers, and features vary by state and may not be available everywhere.

No Lender Affiliation: MarketView Agency is not affiliated with, endorsed by, or acting on behalf of your mortgage lender, loan servicer, or any government agency. Mortgage protection is a form of life insurance; it is not mortgage insurance (PMI) and is not required to obtain or keep your mortgage.

Carrier Names and Marks: Carrier names shown on the Website identify carriers we may be able to quote. Their trademarks belong to their respective owners, and their display does not mean those carriers endorse MarketView Agency. Carrier availability depends on your state, age, health, and other factors.

3. Quotes, Estimates, and Coverage

Quotes Are Estimates: Rates displayed on the Website or provided by an agent are estimates based on the information you provide and the carriers' published rates at that time. They are not offers of insurance and are not guaranteed.

Final Rates Set by the Carrier: Your final premium, coverage amount, and eligibility are determined solely by the insurance carrier after it reviews your application, which may include health questions, prescription and medical records, motor vehicle records, and other underwriting information. A carrier may approve your application at a different rate, offer different coverage, or decline it.

No Coverage Until Issued: Submitting a quote request, form, or application does not create insurance coverage. Coverage begins only when the carrier approves your application, issues a policy, and any required first premium is paid, according to the terms of that policy.

"No Medical Exam" Plans: Some plans do not require a medical exam, but carriers may still ask health questions and review medical, prescription, and other records before deciding.

Accuracy of Your Information: You agree to provide complete, truthful, and accurate information. Incomplete or inaccurate answers on an insurance application can lead a carrier to change your rate, deny your application, rescind your policy, or deny a claim.

4. Educational Tools Are Not Advice

Our coverage calculator, articles, FAQs, comparisons, and other Website content are for general educational purposes only. They are estimates based on the information you enter and general assumptions, and they are not a substitute for a personalized recommendation from a licensed agent. Nothing on the Website is legal, tax, or financial advice. Statements that life insurance death benefits are "generally income-tax-free" are general in nature; consult a qualified tax professional about your situation.

5. Agent Compensation

MarketView Agency is generally paid a commission by the insurance carrier when a policy is issued. You do not pay us a separate fee for quoting or helping you apply. Commission rates may vary by carrier and product. You may contact us to ask about how we are compensated.

6. Communications, Calls, and Text Messages (A2P/SMS Terms)

Consent: Our forms have two separate boxes. When you provide your phone number and check the call and email box, you give your prior express written consent to receive calls and voicemails. Text messages (SMS/MMS) are only sent if you also check the separate, optional text-message box (it is never required to get a quote) or text us first. Together, these give your prior express written consent to receive marketing and informational calls, text messages, and voicemails from MarketView Agency and its licensed agents at the number you provided, including a wireless number, even if that number is on a federal, state, or internal Do Not Call list. These communications may be made using an automatic telephone dialing system or other automated technology, and may include prerecorded messages, artificial or AI-generated voice messages, and ringless voicemails. They may be about your quote request, application, appointments, policy service and reviews, and other insurance products and coverage options that may fit your needs. You also agree that we may email you at any address you provide. Consent is not a condition of purchasing any product or service. You can request a quote or apply by calling us instead. This consent continues until you revoke it, which you can do at any time by any reasonable means, including replying STOP, telling us during a call, or emailing us.

Message Types: Quote follow-ups, appointment scheduling and reminders, application status updates, policy service messages, and occasional information about coverage options.

Message Frequency: Message frequency varies based on your requests and interactions with us.

Cost: Message and data rates may apply depending on your mobile carrier plan.

Opt-Out: You can opt out at any time by replying STOP to any message. You will receive one message confirming that you have been unsubscribed, and you will receive no further text messages from us unless you opt in again. You can also ask us to stop calling you at any time.

Hours: We generally contact you Monday through Saturday, 9 AM to 5 PM Central Time, and in any case only during hours permitted by law in your time zone.

Mobile Information Sharing: Mobile information will not be shared, sold, rented, or transferred to third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties under any circumstances.

Carriers Are Not Liable: Wireless carriers are not liable for delayed or undelivered messages.

Sharing to Get You Covered: When you choose to apply for coverage, we share the information needed with the insurance carrier(s) you select so they can process your application. This sharing is described in our Privacy Policy and does not include selling your information or sharing your mobile opt-in data for marketing.

The Website may link to or connect with third-party websites, including insurance carrier applications, electronic signature tools, and payment portals. Those sites are governed by their own terms and privacy policies. We are not responsible for their content, availability, or practices.

To the fullest extent permitted by law, MarketView Agency and its owners, agents, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of, or inability to use, the Website or Services. Nothing in these Terms limits any rights you have under your insurance policy or any liability that cannot be limited under applicable law, including insurance laws and regulations.

You agree to defend, indemnify, and hold harmless MarketView Agency and its owners, agents, employees, and affiliates from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of the Website, or information you knowingly submit that is false or that you did not have the right to provide.

We may update these Terms from time to time. Changes take effect when posted on this page with a revised "Last Updated" date. Your continued use of the Website after changes are posted means you accept the updated Terms.

14. Governing Law and Venue

These Terms are governed by the laws of the State of Kansas, without regard to its conflict-of-law rules, except where the insurance laws of your state of residence require otherwise. Any legal action relating to these Terms or the Website will be brought exclusively in the state or federal courts located in Kansas, unless the law of your state requires a different venue.
